Ask HN: Advise on drafting a “GPL for contract law”
I am seeking advise from the HN community on questions and talking points I am gathering before engaging a practicing attorney specializing in contract law.
My goal in hiring a lawyer will be to draft the first versions of terms, definitions and modular contracts. The goal of this project will be to clarify and solidify the terms of contracts as a way to combat what I might coin "the I Agree epidemic".
For the contracts, I am initially targeting sales of goods, sales of services, rent and loans.
For the terms, I will initially target current "hot-topic" issues such as data collection, anonymization and handling as well as pricing and liability.
For the definitions, I will initially target the definition of the major factors in the chosen terms.
All first-draft documents will be drafted without concern for local laws and regulation, but will be built with a mind towards allowing the terms, definitions and contracts to be changed and shared.
These contracts will be released under the GNU GPL version 3 or greater.
The reason I am pursuing this course of action is that I believe that instead of seeking new laws and regulation, we should first define what it is that is desired in the marketplace and then facilitate an informed economic solution.
In other words, if we can state what it is that we want then we can find someone who is willing to charge us for it, but we will never convince everyone to want the same thing.
