I am not a lawyer, but I believe that is called defamation of character or slander.
If I were Elon, I would "clarify" my statement to be the literal meaning, vs. the psychological term to avoid giving away even more money. Probably too late for that however.
If this all Musk has, looks like the defamed will be getting some "imaginative" money, maybe tens of millions.

He doubled down repeatedly, telling at least one journalist to go investigate Unsworth. It was clearly not just some random insult, but an earnest accusation.
