Do all these churches that are still wanting to hold in person services even when there is a stay-at-home order have a leg to stand on when claiming violation of the 1st amendment? My naive understanding is as follows:
- The stay-at-home order does not target religion specifically but applies to the vast majority of any sort of non-essential service.
- The slowing of the spread of Covid-19 seems like it would be a compelling interest that would allow the state to prohibit in person religious ceremonies and not violate the Free Exercise Clause
Is there more to it than that? Are my assumptions off-base?
