Ask HN: Does CIFS/SMB implementation require a license from Microsoft?

Going by this - https://www.microsoft.com/en-us/legal/intellectualproperty/mtl/smb-licensing.aspx

it appears that any SMB implementation will require a license from Microsoft. But, I know of may open SMB implementations where there is no royalty fee being paid to Microsoft. Does anyone know or have any experience related to this license/royalty fee?
