Aggregation of candidates based on their own perception of their attributes is not discrimination. This isn't saying noone else can apply to the offered jobs, right?
The service allows potential employers to post jobs ads on a site that openly favors some political affiliations over others. This could (imho) plausibly open up a company posting jobs in NY and CA to a lawsuit.
In CA and NY political affiliation is a protected class just like race. I would be very cautious about posting job ads or even filling open positions using a service like this in CA and NY without talking to a good lawyer.
