There are lots and lots of issues with this but I’ll focus on one: The only reason this is legal is because 100% of the liability is pushed onto these beta testers. No matter what happens, even if the car drives into a group of pedestrians at high speed, Tesla can claim they’re not at fault since the driver by definition wasn’t in control of the vehicle.
Eventually, sufficient representations and warranties are made by Tesla, that they are painted into a corner. There is a lot of boilerplate language that attempts to disavow liability in the Tesla communications to customers. Given the substantial payments made to Tesla, the courts are going to impose liability on Tesla under theories of misrepresentation or contract law. The line will be crossed, and Tesla won't even know it, until the insurers, working on behalf of the individual insured 'drivers' pile onto Tesla.
