Looks like we need to fund an organization ... let's say it's called OSIt ... that such a developer can turn to. It would offer to sponsor community-beneficial software - subjected to such corporate end-runs - to convert to open-source.
Perhaps there are orgs that would understand the necessity for OSIt, and would be willing to endow the sponsorship fund.
