The US really seems like its standing alone in having a constitution that can stand up to the onslaught from covid hysterics. I know the popular opinion here is that's a bad thing, but it's the same reason (possibly) that all the fears about Trump and the bad that a populist strongman could do were not realized. Overall, strong protection of freedom is a good thing. People still have the right to react in whatever way they want, just not project their fear on others, which is exactly where a free society should be.
"If the executive branch is allowed to usurp the power of the legislative branch to make laws, two of the three powers conferred by our Constitution would be in the same hands," he wrote. "If human nature and history teach anything, it is that civil liberties face grave risks when governments proclaim indefinite states of emergency."
While I agree with you that allowing different states to try different approaches to dealing with covid is part of the strength of the US system (and gives some excellent data for how different policies can affect the outcomes for the populations subject to them), I think that downplaying the danger of a populist strongman is the wrong example to pick, given that the US implementation of federalism also lead to a situation where such a leader's supporters came within seconds of destroying the certifications of the vote that kept him from staying in power unlawfully:
It is a good thing. Precedent matters. What happens today via President X will also be available to Future Tyrant Y. We are a country of laws, not situational rule bending.
People are going to be upset about this decision. But they are they same people who cursed the previous administration. They fact they don't recognize that disconnect / hyprocricy is disheartening.
