Musk must know that this is public information in the first place, he can't not know that ADS-B exists.
He doesn't care. He's hoping the threat of a lawsuit is scary enough. The guy should start a fund raiser. Maybe they could preempt this by suing Musk first and get a nice liberal judge. The advantage Musk would have by suing first is finding a corrupt Trump-appointed district.

All that guy has to do is show up in court without a lawyer and say he's protected under settled law and court cases. I assume the ACLU or similar will back him if he asks for their help. It's almost certain any judge this comes before will toss it out based on the 1st amendment and precedent.
This is some more of that free speech absolutism we've been hearing about. Flight paths that are public are protected by freedom of speech up to and including a court decision. Yet it's fine to have tons of white supremacy tweets and loaded threats and slanderous tweets about people without any issues.

He is likely hoping the courts change course if he brings up safety and terrorism. He may not be wrong as the Supreme Court has changed longstanding decisions on larger topics recently.
