Corollary: Is there something in their terms and conditions that would give them rights to perform such nefarious activity with legal impunity?

Github has the same access to public repos that you do.

But they did not take any permission from developers asking if training an AI and generating similar code is fair use. So I would believe there is something in their terms and conditions that makes them think it's fair use.
