Not a lawyer, but I guess that if such data was obtained lawfully before the introduction of paid apis then any academic can just ignore that demand.

Afaik you can’t just retroactively change terms and conditions.

if there's any universe where that statement is legally binding we are definitely not in it lol

not to mention, depending on the license it was obtained, they can probably resell it.

This level of greedyness reminds me Elsevier.
