If you legitimately buy a used apple device, you can get the password from the owner. If you regularly are getting laptops which do not come from the owner, you are probably in cahoots with a street gang to steal them.

Or you're getting laptops from owners that don't know or don't care. Some businesses might not think its worth the time for their IT staff to decommission Apple laptops properly so their junk handler gets better resale values. And its not always easy to contact that guy who was selling stuff on Craigslist after the fact.

Why not have it only get remote bricked if its reported stolen instead of just assuming if some not clear, especially to non-tech people, steps were not done it is?

right to repair creates more security risks, which trumps all arguments. as long as enemies of democracies are making the majority of the peripherals and batteries this concern will always be #1

the real issues with apple is what they charge for software/ideas that were conceived decades ago by other people in the open source world, their licensing of those ideas and the schism that results from it.
