Tell HN: College Park, GA Cops Want to Jail Me for Stolen Identity

6 points by jurynulifcation ↗ HN
Title gives the basic setup. Some short ginger stole my real ID, modified it, then stole a car. The cops won't talk to my lawyer until I show up in person (presumably for them to arrest me). I've had this hanging over my head for about a year now. I don't want to show up to resolve this because they have already demonstrated such wanton incompetence and disregard for my innocence, that I honestly don't trust them to release me duly once they have me in custody. I seriously don't understand how they can just refuse to speak to my legal representative. Any advice on what to do?

IANAL, but has your lawyer tried talking to the DA in GA? Or - are there any federal law (vs. state law) aspects to the case, for you to try dealing with the FBI (or other federal law enforcement)?
I don't think my lawyer can speak to the DA until the warrant for my arrest has been exercised, because there's not really anything to talk to them about.

If a warrant has been issued for the arrest of the wrong person, then there is something for your lawyer to talk to the judge about :P
My understanding is that it's not a matter for the DA until the warrant has been exercised, i.e. the dumbass cops arrest me.
If a warrant has been issued, the police have no choice but to arrest you as soon as they encounter you. The matter is out of their hands. They're under orders by the judge who issued the warrant to take you.

The application for the warrant should be a public record. If your lawyer can point out errors or falsehoods in to application to the judge, he should be able to get the judge to quash it.

Has a warrant for your arrest been issued? If so, your lawyer could file a motion with the judge who issued the warrant to quash it, since the information on the warrant application about the identity of the offender was false.
Yes, but it's only serviceable in GA. I hadn't heard my lawyer mention quashing it with the judge. Thanks for the idea. Brought it up.
Ignore it, Make sure your lawyer is ready to handle it if anything ever come of it. If they had a warrant you would already know.
I know for a fact they do, but it's only serviceable in the state of GA.

Yes. I was a trial lawyer for 40+ years. My advice: stop the nonsense of posting on the internet and talk to the lawyer you already have.

Why is this flagged?
Kinda ot for a tech forum. And the best thing you can do for yourself is to delete this, and any other posts you have made about your legal issues. If your lawyer isnt helping you, and you Are following their advice, find another. This is not the place for either.
