Ask HN: Shop Pay checkout page auto-subscription legality?

On a couple of different sites, simply visiting the Shop checkout page (to see potential shipping costs) was sufficient to subscribe my associated email address to a mailing list. I did not go further than viewing the checkout page, and I did not explicitly consent to sharing my information with the store. How is the dark pattern legal?
