If what you are asking was a valid way to do things, could companies just make some front company in a foreign country to make a website to sell items that are illegal to sell in any other country? When this hypothetical front web company is shut down, another would be started by "unrelated" interests. The article also lists chemicals that are illegal to use in the USA as also being openly sold on EBay, for which EBay is also being pursued by the Justice Department, where I assume the makers are either foreign or possibly domestic but supposedly only for use in foreign countries.
EBay itself does not agree with the logic of your argument either, they agree that selling these things is wrong because they claim the block 99% of the items and from reading that article it's implied that their defense is to be that they cannot stop everything.
