I don't think they're in clear violation, in that the license does not say what they have to do other than make source code available. Malicious compliance is a thing so it might be determined by a court that they're in violation, but I really don't think it is at all clear you would get a court to say that.
Open source let Redhat get away with basically close sourcing RHEL.

Big mistake.
