That's because it's really just not comparably impairing compared to alcohol and uppers.

On the other hand, the cardiovascular health effects, especially at the really high doses with high availability weren't predicted but are still a problem.

None of which changes the fact that putting people in jail for this was dumb and we shouldn't go back.

Well, maybe not, but sober pedestrians increasingly show up in morgues, and if news reports are to believed, a lot of them are hit and run.
