It's not hard to not redirect bit.ly but redirect victims that click the link. Some .gov sites need the redirect for whatever reason, but they could check the referer.
Yes, I believe it is possible that they don't have the data. No, I don't think they collect private messages for targeted advertising or for any purposes at all.
I'm not saying Facebook is right, but following the law isn't necessarily the right thing to do, neither need one always expect punishment.
