Nah, the USC would say it falls under the Inter State Commerce Clause. That thing has been twisted like a pretzel to support expansion of govt power.
The same argument could be raised about health insurance and welfare... sometimes we do things for the common good, where do we draw the line as a society?
And they are a (mostly) homogenous society. Racist, structurally rigid, and dying (birth rate below replacement).
