Hmm, this project doesn't seem to be stemming from Microsoft Zenimax Bethesda Game Studios... there may be trademark and/or copyright issues here... I dunno, something about this gives me bad vibes. Maybe it's just 'cause it ain't OSS.
Anyway Bethesda is really good about this type of thing, they give away some of their of old stuff (Arena and Daggerfall) for free-as-in-beer and considering their cooperation with modders for nearly every title they release I don't think I've ever seen them get ornery over a remake.
Sfall has been around a long time too. I wouldn't worry.
Interplay does not have the rights anymore. They actually had some kind of deal with Bethesda back when Interplay were in dire straits that allowed them to make a Fallout MMO type of experience after selling the Fallout IP for a couple million dollars to Bethesda. However, they had to do it on a rather compressed schedule, which they naturally didn't meet on their end. Therefore, they lost everything post 2009.
Interplay also did a Fallout classics retail release which included Fallout, Fallout 2, and Fallout Tactics. But Bethesda told them they no longer had the rights and Interplay had to get it pulled off store shelves. This was also around 2009 or thereabouts.
For me the Fallout 3 was the "3D remake".
It's also a perfect example of uncanny valley phenomenon and the reason why older games has so much charm. When I play Fallout 3 I see empty spaces and unrealistic places. At the same time, playing Fallout 1 or 2, visiting cities made of a very crude architecture and a few sprities invokes deep connection and memories.
Same as with books, your mind has to fill out all the empty spaces and make the story yours.
For that reason I don't look up for any 3D remake of any old game I played and treasure.
